Terms of Service
Effective July 3, 2026
These Terms of Service ("Terms") govern your use of the SiteDevelopers website at sitedevelopers.ca and describe our Website-as-a-Service ("WaaS") offering in general. By using our site or submitting an inquiry, you agree to these Terms.
Service agreement
Browsing this site or requesting a free mockup does not start a paid subscription. If you choose to move forward and become a client, we will send you a separate service agreement for review and signature before your plan begins or any recurring billing starts.
That signed agreement will set out your plan, pricing, billing cycle, scope of work, and other terms specific to your project. If anything in the signed agreement conflicts with these website Terms, the signed agreement applies to your client relationship.
Our services
SiteDevelopers provides custom website design, development, hosting, SSL, maintenance, and ongoing support on a monthly or annual subscription basis. Services vary by plan (Basic, Pro, or Premium) as described on our pricing page.
Key aspects of our model:
- Free mockup: we may create a homepage mockup at no cost before you commit
- No upfront build fee: your subscription begins only after you approve the final website
- Flexible billing: choose monthly (cancel with 30 days notice) or annual (2 months free when you pay for the year upfront)
- Managed service: while subscribed, we host and maintain your site; ownership terms are described below
Eligibility
You must be at least 18 years old and authorized to enter into agreements on behalf of yourself or your business. You agree to provide accurate information when contacting us or signing up for services.
Free mockup and approval
Mockups and design concepts are provided at no charge and with no obligation. If you do not approve a mockup or final site, you owe nothing. Once you approve the final website, your paid plan begins only after you sign the service agreement and billing is set up.
Subscription and payment
- Plans are available on a monthly or annual basis. Annual plans are billed once per year in advance and include 2 months free (you pay for 10 months, get 12)
- Monthly fees are billed in advance on a recurring basis according to your selected plan
- Payments are processed by Stripe. By subscribing, you agree to Stripe's terms and privacy practices. We do not store your full payment card details. Stripe handles payment processing securely on our behalf
- Prices are listed in Canadian dollars unless otherwise stated
- You may upgrade or downgrade your plan; we will adjust scope and billing accordingly
- Failure to pay may result in suspension of your website and related services after reasonable notice
- Third-party costs (such as Zoho Mail subscriptions for business email) may apply separately as described in your plan
Your responsibilities
As a client, you agree to:
- Provide accurate business information, content, images, and approvals in a timely manner
- Ensure you have rights to any content, logos, or materials you supply
- Keep your contact and billing information up to date
- Use your website lawfully: no illegal content, malware, spam, or material that infringes others' rights
- Stay within the page limits and update allowances of your plan, or upgrade when needed
Intellectual property and site ownership
While your subscription is active, SiteDevelopers designs, builds, hosts, and maintains your website as a managed service. The website, underlying code, and design remain our property unless otherwise agreed in writing.
Content you provide (text, logos, photos, business information) remains yours. You grant us a license to use that content solely to build and operate your website.
If you cancel, your site may be taken offline at the end of your notice period. We may offer a buyout option for you to take full ownership of the site. Terms and pricing for buyout will be discussed separately upon request.
Domain names and email
You are responsible for registering and renewing your domain name unless we explicitly agree to manage it for you. We will configure DNS, hosting, SSL, and email (forwarding or Zoho Mail setup per your plan) on your domain. If you cancel, we will assist with DNS transfer where reasonably possible.
Service availability
We aim for reliable hosting and uptime but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, or events beyond our control may cause temporary downtime. We will make reasonable efforts to restore service promptly.
Content updates and support
Each plan includes a defined number of content updates per month (or unlimited minor updates on Premium). Updates are limited to content changes within your existing design. Major redesigns or new features may require a plan upgrade or separate agreement.
Cancellation
Monthly plans: you may cancel at any time with 30 days written notice by emailing hello@sitedevelopers.ca. Cancellation takes effect at the end of the notice period.
Annual plans: your subscription runs through the end of your prepaid annual term. Annual fees are non-refundable unless required by law. You may choose not to renew at the end of your term.
Fees already paid are non-refundable unless required by law.
Limitation of liability
To the fullest extent permitted by law, SiteDevelopers is not liable for indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability for any claim related to our services is limited to the amount you paid us in the 12 months preceding the claim.
We are not responsible for loss of business, revenue, data, or profits resulting from website downtime, third-party service failures, or your failure to maintain backups of content you provide.
Disclaimer
Our services are provided "as is." While we use professional practices for design, SEO, and hosting, we do not guarantee specific business results, search rankings, or traffic levels.
Indemnification
You agree to indemnify and hold SiteDevelopers harmless from claims arising from content you provide, your use of the website, or your violation of these Terms.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Ontario.
Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance. For material changes affecting active subscriptions, we will provide reasonable notice.
